Right Plan Communications LTD - Mobile Terms and Conditions of Business since 10/01/2014

It is essential that you read these Terms and Conditions properly. We, Us means Right Plan Communications LTD. Mobile Phone Equipment means any cellular telephones and accessories supplied by us under the contract. 

Right Plan Communications LTD reserves the right to make any changes in the specification of the services which are required to conform with any applicable law, regulation or safety requirements which is not in existence or within the reasonable contemplation of the parties at the effective date or which do not materially affect their quality or performance. If any variation in the services or the agreement is agreed or is required for compliance with any applicable law, regulation or safety recommendation, The customer shall pay such additional amount as is fair and reasonable and Right Plan Communications LTD shall have reasonable additional time to perform the Agreement.

Airtime Contract
All Mobile Phone Equipment supplied by us is subject to a minimum contract length through the relevant Network.

Delivery
Delivery of all Mobile Phone Equipment and any other items will be made within 7 working days. This period is an estimate only and we cannot be liable for late delivery unless the delay exceeds a period of 30 days from the date of your signed order. We cannot be held responsible for late delivery due to insufficient or wrong information provided, or delays in the connection process, this includes mandatory proofs requested by the network and completion of the network contract. Any goods received damaged or with missing items must be reported to us within 24 hours of delivery. Deliveries are only made within the UK only.

Prices
Unless stated otherwise, all prices are excluding VAT.

Payment
If you receive an invoice from us, payment must reach our offices within 30 days of the date on the invoice. If we do not receive full payment, we have the right to charge interest and administration fees. We will not perform this right if you have notified us of a valid reason for non-payment within this given time frame and a payment plan between yourself an us is agreed.

Insurance
We shall not be held responsible for the insurer not accepting an application for insurance cover.

Mobile Number Porting
We cannot be held responsible for any financial loss due to a mobile number port failure. If any problems occur we must be notified within 24 hours.

Ownership
You will not receive the product until we receive payment from the network in full. Ownership shall not pass until you have fulfilled the minimum term of the airtime contract. If you end the airtime contract before the minimum term has been satisfied, you will be responsible for repaying us the original retail price of the mobile phone equipment at the date of your original connection.

7 Day Guarantee
You have 7 days from the date of your order to cancel your contract. This does not include upgrades. To cancel your contract you must call us on 02381781230 and then confirm the cancellation in writing. You must then return any Mobile Phone Equipment and any accessories given with the equipment within 7 days. The charges for returning these goods are your responsibility. We recommend you use a registered post or a courier with insurance. When the mobile phone equipment is returned in its original state within the 7 day period, the airtime agreement will be cancelled. Any calls you have made during the time you have had the mobile phone equipment: along with line rental pro rata for any period you have made use of the mobile phone equipment will be charged. If the products are not returned in its original state we have the right to charge you for the reduction in the resale value as a result of not being returned in its original condition, (up to the maximum charge of the original retail list price for the item excluding all offers, discounts and promotions at the date of your original order). If you do not cancel the contract within the 7 day period you will be subject to the minimum term as stated in your order. nothing in these terms affect your statutory rights relating to faulty goods or services provided.

Minimum Term
This is the contract length as stated in your order and on your airtime contract. If either side was to leave the agreement before this period without written confirmation & acceptance from our selves then this would be subject to the claw back rules mentioned below.

Upgrades
When upgrading your handset or Network tariff you are committing to a new minimum term airtime contract with your mobile network. Ownership and airtime contract conditions apply. Please see above. The 7 day money back guarantee is not eligible with upgrades.

Our Responsibility to you
We will perform the contract with reasonable skills and care. We will also provide 3/6 month courtesy calls to ensure you are not having any issues with the network or equipment we have provided you. We shall not be responsible for airtime charges during any period. In no circumstances shall we be liable for any loss or damage arising out of or relating to the services that we provide which is for any loss of profits, loss of sales, loss of turnover, loss of bargain, loss of opportunity, damage to goodwill or reputation, loss of use of any apparatus, software or data loss or time on the part of management or the staff of any indirect or consequential loss or damage however so arising for death or personal injury, in the event that you use an item for commercial purpose then we shall not be liable to you for any loss of income, business or profits or any other economic loss arising out of your use of inability to use any item, however this loss may be caused and wherther or not it is a result of your own negligence.

Line Rental Subsidy / Cash Back / Termination Claw Back
If the tariff is changed, phone is disconnected or you have failed to pay the network or the phone is showing no minimal usage, we have not been paid commission or if the minimum term of the contract has not been satisfied, we have the right to clawback any line rental subsidy or termination costs that have been paid to you and also the original cost of any hardware supplied by us.

Your Statutory Rights
Your rights and obligations under these terms and conditions are direct to you and only you. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizens Advice Bureau.

General Conditions
Your rights under these terms and conditions are personal to you and your company and may not be assigned to anyone else. We may transfer our rights and or obligations under these terms and conditions or any part thereof. By accepting and making use of the hardware supplied by us, you are accepting the terms and conditions of your contract. All of these terms and conditions mentioned above can be viewed at anytime on our website. Your contract is governed by English law. 

Data Protection
All parties will ensure that in storing and processing personal data they will at all times comply with the provisions of the latest Data Protection Laws (including EU GDPR) together with any subsequent re-enactment or amendment thereof, and all personal data acquired by either party from the other will be processed lawfully and securely. The parties hereby acknowledge that performance of a duty imposed by legislation will not constitute a breach of any obligation in respect of confidentiality or privacy or otherwise pursuant to the terms and conditions which may be owed to the other party. Confidentiality
Each of the parties undertakes to the other to keep confidential all information (written or oral) concerning the business and affairs of the other that it shall have obtained or received as a result of the discussions leading up to or entering into of this Agreement. The only time information may be passed on is with written permission.
